Southampton Village loses a FOIL lawsuit to a self-represented resident

Southampton Village resident Christopher Broich won an Article 78 lawsuit against Southampton Village after the village denied his Freedom of Information Law request.

The FOIL lawsuit turned on records from a June 2, 2024, incident at the Southampton Publick House: the incident report, arrest and charging papers, and body and in-car camera footage. The village closed the request, and Village Administrator Scott Russell, the village’s FOIL appeals officer, denied the appeal. Suffolk County Supreme Court Justice Maureen T. Liccione ordered the records released, with some redactions allowed. Broich represented himself, and the court said he may recover his litigation costs if he submits them with a sworn affirmation.
