Does a police department have to explain redactions to body camera footage?

THE QUESTION

We requested body camera footage from a police department through a FOIL request. When we finally received the footage, it appears that the majority of it has been redacted. Is there a way to obtain the unredacted footage?

OUR ANSWER

If the police department, in response to your FOIL request, provided redacted body camera footage, they should have provided reasons for the redactions made.

You can file an administrative appeal regarding the reasons provided. Otherwise you will have to file an Article 78 proceeding, which has a very short statute of limitations.
