Can government agencies just give themselves an extension for a FOIL request?

QUESTION

I got this notice regarding a FOIL request to the state DOL (Department of Labor).

Is it legal for an agency to say “we couldn’t fulfill your request in 20 days so we’ll give you things in 3 months instead” ?
My impression was that they had to use shorter timeframes.

Maybe I’m wrong. Any insight?

Unfortunately they can take 90 days to respond to your FOIL request, as indicated by the Committee on Open Government opinion below.

You can file an appeal objecting to the delay. Sometimes, they will respond quicker, but not always.
